Terms & Conditions

These terms govern the sale of artworks, prints and merchandise through bentrushmore.com, and explain how we handle your personal data. The online shop is operated by Massruum OÜ (“we”, “us”), the company behind Bent Rushmore. Please read them before placing an order — by completing a purchase you agree to them. Alongside these terms, the laws of the Republic of Estonia apply.

For anything to do with an order, a return, a complaint or your personal data, email us at the address above and we’ll reply as soon as we can — at the latest within 14 days.

2. The works we sell

We sell original paintings and ink drawings, limited prints, and magnets and other merchandise. Original works are one of a kind: once a piece is sold it is marked as such and removed from sale. We photograph every work as faithfully as we can, but screens vary, and the colour, texture and scale of an original may differ slightly from its image online.

3. Prices

Prices are shown on each product page in euros and include VAT at the applicable rate. Any delivery charge is calculated and shown separately during checkout, before you confirm and pay. We may change prices and these terms at any time; the version published here when you place your order is the one that applies to that order.

4. Placing an order

Add the works you want to your cart, then follow the steps at checkout — fill in your details, choose a delivery method and pay. A sales contract is formed once you have completed payment and we have sent you an order confirmation by email. If we cannot fulfil an order (for example, a one-off work has just sold), we will let you know and refund any amount you have paid.

5. Payment

Orders are paid in full at checkout using one of the payment methods offered there. Payments are handled by a third-party payment provider over an encrypted connection; we never see or store your full card or bank credentials. An unpaid order is cancelled automatically.

6. Delivery

Once payment has cleared we prepare your order and hand it to our delivery partner. Estimated delivery times and any available shipping options are shown at checkout; these are estimates, not guarantees. We pack original works with particular care. Risk of loss or damage passes to you when the order is delivered. We are not responsible for delays caused by the carrier or by circumstances beyond our reasonable control once the order has been dispatched on time.

7. Right of withdrawal (14 days)

If you are a consumer, you have the right to withdraw from your purchase within 14 days of receiving the goods, without giving a reason. To do so, tell us in a clear statement by email at hello@bentrushmore.com within that period. You then have 14 days to return the goods.

Returned goods must be unused and in their original condition and packaging. You bear the direct cost of returning the goods, unless what arrived was faulty or not what you ordered. We will refund the amount you paid, including the original standard delivery cost, within 14 days of receiving the goods back or of receiving proof that you have sent them — using the same means of payment you used, unless you agree otherwise.

The right of withdrawal does not apply to works made or personalised to your specification (for example, a commissioned piece). This does not affect your statutory rights if a work is faulty.

8. Faulty goods & complaints

We are liable for any lack of conformity that becomes apparent within two years of delivery. If a work reaches you damaged, faulty or not as described, email us at hello@bentrushmore.com with your order number and a description (photos help). We will get back to you within 14 days and, where the claim is justified, repair or replace the work or refund you, together with the delivery cost. We are not liable for damage caused by misuse, improper storage or normal wear — and works on paper and canvas should be kept out of direct sunlight and damp.

9. Resolving disputes

We would always rather sort out a problem directly, so please contact us first. If we can’t reach an agreement, a consumer in Estonia may refer the matter to the Consumer Disputes Committee at the Consumer Protection and Technical Regulatory Authority (Tarbijakaitse ja Tehnilise Järelevalve Amet, Endla 10A, Tallinn — ttja.ee). These terms and any dispute are governed by Estonian law.

10. Copyright

Copyright in every work — and in the text, images, music and design on this website — remains with the artist. Buying a piece gives you ownership of that physical object, but not the right to reproduce, copy, resell as reproductions, or use the image commercially. Please don’t reuse anything from this site without permission.

11. Privacy & your data

Massruum OÜ is the controller of any personal data you give us through this site, and we process it under the EU General Data Protection Regulation (GDPR) and Estonian law. We treat it as confidential and never sell it.

What we collect and why

  • To fulfil your order — your name, delivery and billing address, email and the details of your purchase. The legal basis is performing our contract with you; we also keep what tax and accounting law requires.
  • To send our newsletter — your email address, if you subscribe. The legal basis is your consent, which you can withdraw at any time by unsubscribing or emailing us.
  • To run and secure the site — standard technical data such as your IP address. The legal basis is our legitimate interest in a working, secure shop.

Who we share it with

We share data only with the service providers we need to run the shop — our hosting provider, our payment provider, the delivery partner that ships your order, and the tools that send our email — and only to the extent each needs to do its job. They act as our processors under data-processing terms. We may also disclose data where the law requires it.

How long we keep it

We keep order and accounting records for as long as Estonian law requires (generally seven years), and newsletter subscriptions until you unsubscribe.

Your rights

You can ask us to see, correct, delete or export your data, or to restrict or object to how we use it, and you can withdraw any consent at any time. Email hello@bentrushmore.com and we’ll help. If you think we’ve mishandled your data, you can also complain to the Estonian Data Protection Inspectorate (Andmekaitse Inspektsioon, aki.ee).

Cookies

This site uses only the cookies needed to make it work — for example, to remember what’s in your cart. You can block cookies in your browser settings, though parts of the shop may then not work as intended.
